4. Lawful Basis of Processing

Under DPDP Act §4–6, we process your personal data only when a lawful basis exists:

  • Consent: You have given clear, informed, specific, and free consent for one or more specific purposes (e.g., newsletter sign-ups, marketing).
  • Contractual Necessity: Processing is necessary to fulfil a contract or to take steps at your request before entering into a contract (e.g., account registration, property bookings).
  • Legal Obligation: We are required to process data to comply with applicable Indian laws and regulations.
  • Legitimate Interest: We process data to pursue our legitimate interests (e.g., fraud prevention, platform security) where these are not overridden by your rights.
  • State Functions / Public Interest: Processing authorised by the State or required for public-interest functions as recognised under the DPDP Act.

5. Purpose of Processing

  • Create and manage your user account on PropertyCab
  • Display, filter, and match property listings to your search preferences
  • Facilitate communication between property buyers/renters and sellers/agents
  • Process property enquiries, visit bookings, and post-requirements
  • Verify agent credentials and RERA registration numbers
  • Send transactional emails, notifications, and service updates
  • Send promotional communications (only with your consent)
  • Prevent fraud, detect abuse, and ensure platform security
  • Comply with applicable laws and regulatory obligations
  • Improve and personalise the platform experience through analytics

6. Data Retention

Under DPDP Act §8(7), we retain personal data only for as long as necessary for the stated purpose or as required by applicable law.

Once the retention period expires, data is securely deleted or anonymised unless a longer retention is mandated by law.

7. Your Rights as a Data Principal

Under DPDP Act §11–13, you have the following rights. To exercise any of these rights, contact our Grievance Officer (Section 12).

Right to Access

Obtain a summary of your personal data being processed and the processing activities.

Right to Correction

Request correction of inaccurate or incomplete personal data.

Right to Erasure

Request deletion of your personal data when it is no longer necessary for the purpose it was collected.

Right to Grievance Redressal

Have your grievances addressed by our Grievance Officer within 30 days.

Right to Nominate

Nominate another individual to exercise your rights in the event of your death or incapacity.

Right to Withdraw Consent

Withdraw consent at any time (where processing is consent-based), without affecting prior processing.

We will respond to all valid requests within 30 days. Certain rights may be limited where required by law (e.g., data needed for an ongoing legal obligation).

8. Data Security

We implement appropriate technical and organisational security measures to protect your personal data from unauthorised access, accidental loss, alteration, disclosure, or destruction, in line with DPDP Act §8 and the IT (Reasonable Security Practices) Rules, 2011.

Under DPDP Act §16, the Central Government may restrict the transfer of personal data to certain countries. We ensure that any cross-border transfer of your data occurs only to countries notified as permissible under the Act.

Where we use third-party service providers located outside India (e.g., cloud hosting, analytics), we ensure appropriate contractual safeguards are in place. Our primary data infrastructure is hosted in India.
